All reservations are subject to the Terms & Conditions outlined below. You may contact our office if you have any questions regarding our policies.

CANCELLATION POLICIES:

FOR RESERVATIONS DURING HEDONISM GROUP RATE EVENTS:

  • Cancellations 121 days or more prior to departure will incur in a $50.00 per person cancellation fee.
  • Cancellations 91-120 days prior to departure will incur in a $100.00 per person cancellation fee.
  • Cancellations 61-90 days prior to departure will incur a 50% (of total cost) penalty.
  • Cancellations made 60 days or less prior to departure or after: NO REFUND
  • Note: Cancellation policy may vary for specific events.
  • *Cancellations must be in writing by emailing your cancellation request to customerservice@ToplessTravel.com.

FOR RESERVATIONS DURING DESIRE GROUP RATE EVENTS:

  • Cancellations 151 days or more prior to departure will incur a 50% cancellation fee.
  • Cancellations 91-150 days prior to departure will incur a 75% (of total cost) penalty.
  • Cancellations made 90 days or less prior to departure or after: NO REFUND
  • Note: Cancellation policy may vary for specific events.
  • *Cancellations must be in writing by emailing your cancellation request to customerservice@ToplessTravel.com.

FOR RESERVATIONS DURING SPECIALTY EVENTS:

  • Cancellations 151 days or more prior to departure will incur in a $50.00 per person cancellation fee.
  • Cancellations 101-150 days prior to departure will incur a 50% (of total cost) per person cancellation fee.
  • Cancellations made 100 days or less prior to departure will incur a 100% penalty. NO REFUND!
  • Note: Cancellation policy may vary for specific events.
  • *Cancellations must be in writing by emailing your cancellation request to customerservice@ToplessTravel.com.

FOR RESERVATIONS DURING CRUISE EVENTS:

  • The cancellation and transfer policy for cruise events is not set by Topless Travel. It is set by the charter company of the cruise.
  • For policy details, please refer to the General Information section on each individual cruise page on the Topless Travel website.

FOR INDIVIDUAL (FULL-FARE) RESERVATIONS:

  • Automatic one (1) night charge for room guarantee.
  • Cancellations with more than 45 days notice incur a $150 USD processing fee.
  • Cancellations with 45 days or less notice is a two (2) night penalty.
  • No refunds provided for no shows.
  • Note: Cancellation policy may vary for specific reservations.
  • *Cancellations must be in writing by emailing your cancellation request to customerservice@ToplessTravel.com.

RESERVATION TRANSFER POLICY:

  • For a transfer request to another event received 46 days or more prior to departure a $250 fee will be applied. The Cancellation Policy from the original reservation will apply to the new reservation.
  • Transfers to another event will not be allowed 45 day or less prior to departure. Please see Cancellation Policy for the reservation.
  • Note: Transfer policy may vary for specific reservations and events.
  • *All requests to transfer a reservation must be in writing by emailing your request to customerservice@ToplessTravel.com.

RESERVATION CHANGE POLICY:

  • Individual guest changes made 30 days or less prior to departure are subject to a $50.00 fee.
  • Changes for all guests listed on a reservation, the Cancellation Policy for the reservation applies.
  • *All requests to change a reservation must be in writing by emailing your request to customerservice@ToplessTravel.com.

AGE LIMITS – We do not accept bookings from anyone that will be under 21 years old at the time of our event.

CREDIT CARD SAFETY – Topless Travel, we want you to feel safe and secure booking your travel with us online. For this reason, we use Secure Socket Layer (SSL) technology to encrypt your credit card and other sensitive information when you make reservations. The process of encryption prevents unauthorized individuals from viewing your information as it is securely transmitted over the Internet. Once received, your credit card information is not transmitted over the Internet again.

PUBLIC HEALTH & SAFETY – The Cruise Line is establishing protocols and procedures related to public health and safety, as may be updated, revised, amended or otherwise changed from time to time by the Cruise Line in its sole discretion (“Cruise Line’s Public Health and Safety Protocols”) in order to mitigate against the spread of SARSCoV- 2/COVID-19. As an express condition to allow the Cruise to proceed, the Purchaser agrees to comply with the Cruise Line’s Public Health and Safety Protocols as they may be updated from time to time, as well as any applicable government or regulatory orders. Purchaser shall ensure that its Passengers become familiar with and comply with the Cruise Line’s Public Health and Safety Protocols and all applicable regulatory orders, which may include, but not be limited to, mandatory SARS-CoV-2/COVID-19 testing, mandatory face coverings and physical distancing measures while on the Vessel.

Purchaser will communicate the Cruise Line’s Public Health and Safety Protocols and all sailing guidelines to each Passenger prior to the Cruise, which incudes, without limitation, via email, website, newsletters or any communication mediums that Purchaser reaches Passengers. Prior to boarding, Passengers will be required to complete any Covid-19 related acknowledgements and comply with any COVID-19 related requirements as is generally implemented on the Cruise Line’s Passengers, which may include, without limitation, the Cruise Line’s Guest Health, Safety and Conduct Policy, health or safety instructions, or other posted signage. Failure to do so by Purchaser or any Passenger will lead to the applicable Passenger and its traveling party being denied boarding or constitute cause for removal from the Vessel without any refund.

OFAC / TRADE SANCTION COUNTRIES – The U.S. Department of Treasury’s Office of Foreign Asset Control (OFAC) administers a variety of trade embargoes and economic sanctions programs that are applied to some countries.
Currently, the most restrictive measures are imposed against the following Sanctioned Countries:
Cuba, Iran, Sudan, North Korea and Syria
U.S. law prohibits us from providing services and engaging in business transactions with individuals and entities located in or residents of these Sanctioned Countries. This prohibition also extends to doing business with Sanctioned Countries indirectly through third parties. This means we cannot, either directly or indirectly through a third party market or sell vacations, make bookings, reserve tours or excursions, and provide other travel-related services to individuals or entities located in or residents of these Sanctioned Countries. To ensure compliance with these laws, we must adhere to these requirements. We know these restrictions can be challenging to our business because we operate in a global market, but as we continue to expand our operations we must maintain our vigilance in adhering to applicable trade sanctions laws.

TRAVEL DOCUMENTS – Your final documents (if applicable) and arrival information will be emailed approximately 30 days prior to the event pending we have received final payment for your reservation. Please check your documents for accuracy immediately upon receipt. Call Topless Travel immediately if you have any questions.

TRANSPORTATION – You must provide Topless Travel your flight information 30 days prior to departure so that we can arrange for suitable shuttle transfers to and from your destination. If we do not receive your flight information then you will be responsible for your own transportation.

Topless Travel reserves the right to charge processing fees in the event of refunds, cancellations or special services. Should a dispute occur, charge-backs will be reviewed on an individual basis. You will be billed for any costs made and involved taking into account the limits of our liabilities, policies and responsibilities outlined in this agreement.

ARBITRATION – Arbitration shall be used for alleged violation of civil rights, discrimination, consumer or privacy laws, or for any losses, damages or expenses relating to or in any way arising out of or connected with this contract or passenger’s cruise, no matter how described, pleaded or styled, shall be referred to and resolved exclusively by binding arbitration pursuant to the United Nations convention on the recognition and enforcement of foreign arbitral awards (New York 1958), 21 U.S.T. 2517, 330 U.N.T.S. 3, 1970 U.S.T. LEXIS 115, 9 U.S.C. §§ 202-208 (‘The Convention‛) and the Federal Arbitration Act, 9 U.S.C. §§ 1, ET SEQ., (‚FAA‛) and shall be heard solely in Miami, Florida, USA to the exclusion of any other forums.

The arbitration shall be administered by the American Arbitration Association under its commercial dispute resolution rules and procedures, which are deemed to be incorporated herein by reference. Neither party will have the right to a jury trial nor to engage in pre-arbitration discovery except as provided in the applicable arbitration rules and herein, or otherwise to litigate the claim in any court. The arbitrator’s decision will be final and binding. Other rights that passenger or carrier would have in court also may not be available in arbitration. An award rendered by an arbitrator may be entered in any court having jurisdiction under the convention or FAA. Passenger and SLSEvents, LLC further agree to permit the taking of a deposition under oath of the passenger asserting the claim, or for whose benefit the claim is asserted, in any such arbitration.

All parties agree, that the verdict of the arbitration panel shall be final and binding on all parties.

DISCLAIMER OF LIABILITY – Topless Travel is acting only as an agent for suppliers in selling travel related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). This travel agency, therefore, shall not be responsibility for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, injury or death to you or your travel companions or group members. Unless the term “guaranteed” is specifically stated in writing on your ticket, invoice, or reservation itinerary, we do not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling, or handling of personal effects. Topless Travel shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social, or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside Topless Travel’s control. Traveler assumes complete and full responsibility for, and hereby releases this travel agency from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department. For medical information, call the Public Health Service. By embarking upon his/her travel, the travelers voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of such risks, and is advised to obtain appropriate insurance coverage against them. Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.
